Who you are contracting with, what it costs, how you pay, and how to get your money back. Published because section 43(1) of the Electronic Communications and Transactions Act 25 of 2002 requires it, and because you should not have to guess.

We do not belong to any self-regulatory or accreditation body for this industry, and we subscribe to no industry code of conduct. There is no such body we could join for tender-preparation software in South Africa, and we would rather say so than imply an endorsement we do not have. We are not accredited by, appointed by, or affiliated with National Treasury, the eTenders portal, any municipality, or any other organ of state.

2. Address for legal service of documents

Legal documents may be served at our registered office in Roodepoort, Johannesburg, as recorded with the Companies and Intellectual Property Commission under registration number 2026/604793/07. That record is public and gives the full street address; we do not repeat it here. It is a physical address at which service can be effected, not a post box.

3. A sufficient description of what we supply

Tender Pack Engine is web-based software for preparing bids for South African public-sector tenders. It is supplied as a service over the internet; nothing is shipped to you and there is no physical product.

The main characteristics of the service:

What the service is not. It does not submit, sign, deliver or lodge anything on your behalf. It does not give legal, financial or procurement advice. It cannot obtain a tender for you, influence an evaluation, or guarantee that a bid will be accepted, be declared responsive, or win. Any claim to the contrary is not made by us. The rule-based reading of a tender document is an aid, not a substitute for reading the document yourself, and you remain responsible for what you submit.

Known limitations we disclose up front. There is no optical character recognition: a scanned or photographed document contains no extractable text, so no expiry date can be read from it and you must enter that date yourself. The requirement catalogue covers twenty common returnable document types; a requirement outside that catalogue, or written in prose in an annexure rather than listed in a returnables schedule, may not be detected. There is no uptime guarantee.

4. The full price, including taxes and every other cost

Current prices for every self-service plan are published on the pricing page and are the full amount payable in South African Rand. There are no setup fees, no activation fees, no per-document fees, no delivery costs and no other charges of any kind.

No VAT is charged, because we are not a registered VAT vendor. The amount shown is the amount debited. If we register for VAT in future, the published price will not increase for that reason.

Prices for Enterprise and Supplier Development cohort contracts are not published; they are quoted individually, excluding VAT, and are set out in the quotation and the signed agreement rather than on this website.

Your own bank or card issuer may charge you a fee for the transaction, or apply a currency conversion if your card is not issued in South African Rand. That is a charge by your bank, not by us, and we do not receive any part of it.

5. The manner of payment

Payment is made online through Payfast, a South African payment gateway, using a debit or credit card or an instant EFT from your bank account. Cohort contracts are invoiced and paid by electronic funds transfer against a purchase order, with no gateway involved.

We use a redirect integration: you enter your card details on the gateway's own secure page, not on ours. We never see, receive or store your card number, expiry date or CVV. Where you choose to keep a card on file for a monthly plan, the gateway stores the card and gives us only an opaque reference which cannot be used to reconstruct the card details.

6. The terms that apply, and how to store and reproduce them

The terms of the agreement are our Terms of Service, our Refund Policy and our Privacy Notice, together with this disclosure and the plan you select. They are published as ordinary web pages, so you can read them before you order, print them, save them to your device, or copy them into any document. They contain no scripts that prevent copying or printing. On request to admin@countpilot.co.za we will email you a PDF of the versions that applied on the day you contracted.

Guarantees. The only guarantees we give are those in the Terms of Service and the Refund Policy, plus the rights the Consumer Protection Act 68 of 2008 gives you and which we cannot and do not exclude. We do not guarantee any tender outcome.

7. The time within which the service is rendered

Access is granted as soon as the payment gateway confirms the payment to us, which is normally within a few minutes. It is granted by the gateway's confirmation, not by the page your browser returns to, so if the browser returns before access appears, the page will keep checking and access will follow. If access has not been granted within 24 hours of a successful payment, email admin@countpilot.co.za and we will either fix it or refund the payment in full.

Cohort seats are provisioned on receipt of a valid purchase order, according to the delivery schedule in the signed agreement.

8. How to access and keep a full record of the transaction

Every payment produces an invoice which appears in your account and is emailed to the address on the account. Invoices remain available for download for as long as your account exists, and for the retention period stated in the Privacy Notice after it closes. Your account also shows the plan you are on, the date of the next charge if any, and a log of the metered actions you have used.

You can export everything you have put into the service, and everything it has produced for you, as a ZIP file at any time — including after you have stopped paying.

9. Return, exchange and refund policy

The full policy is published at Refund Policy. In summary: your first charge on any plan is refundable in full for seven days, for any reason, with no explanation required; you may cancel a monthly plan at any time with one click, with no notice period and no penalty; and there is a separate, deliberately narrow promise about a returnable document that our responsiveness check showed as valid, whose limits are published beside it.

Because this is a service delivered electronically and not goods, there is nothing to return or exchange.

10. Security of payment, payment information and personal information

Card details are captured on the payment gateway's own PCI-DSS compliant pages and never reach our servers, so there is no card data in our systems to be stolen. All traffic to this website is encrypted with TLS. Payment notifications from the gateway are verified by signature, by source, and against the amount we expected for that specific order before any access is granted, so a forged or replayed notification cannot buy a plan.

How we handle your personal information — including the documents in your compliance vault, which of them may be sent where, and which are never sent anywhere — is set out in full in our Privacy Notice, published in terms of section 18 of the Protection of Personal Information Act 4 of 2013.

11. Minimum duration of the agreement

Monthly plans have no minimum duration. They run month to month, you may cancel at any time with one click, there is no notice period and no cancellation penalty. Cancelling takes effect at the end of the period you have already paid for.

One Bid is a single once-off payment. Nothing recurs and no card is charged again.

Annual prepayment is offered only to juristic persons — companies, close corporations and trusts — and runs for the twelve months paid for.

Cohort contracts have the term stated in the signed agreement, typically six or twelve months.

12. Your rights under section 44 of the ECT Act

Section 44 gives a natural person who concludes an electronic transaction the right to cancel without reason and without penalty within seven days after the date the agreement was concluded, for services, and to receive a refund of everything paid within 30 days, with the only charge being the direct cost of returning goods, which does not arise for a service.

Section 42(2) says those rights do not apply to some transactions, and there is an argument that they do not apply to a service a customer starts using immediately. We do not rely on that argument. Our published Refund Policy gives every customer, natural person or company, a full refund on a first charge for seven days, whether or not section 44 applies to them, and whether or not they have used the service in the meantime.

To exercise this right, email admin@countpilot.co.za from the address on the account, or use the cancel-and-refund control in your account settings. You do not need to give a reason.

13. Reviewing, correcting and withdrawing before you place an order

Section 43(2) requires an opportunity to review the whole transaction, correct any mistake, and withdraw from it, before finally placing the order. On our checkout page, before any payment is taken:

If you nonetheless pay for the wrong thing, tell us within seven days and we will refund it in full. Section 43(3) also gives you a right to cancel within 14 days if we have failed to make the information on this page available to you.

14. Complaints, disputes and dispute resolution

Please raise anything with us first at admin@countpilot.co.za. We answer complaints ourselves; there is no queue and no call centre.

We do not subscribe to an alternative dispute resolution code, and again we would rather say so than name a body we have no relationship with. That does not take away any of your rights: you may complain to the Consumer Goods and Services Ombud or the National Consumer Commission under the Consumer Protection Act 68 of 2008, to the Information Regulator about anything concerning your personal information, or approach a court with jurisdiction. Complaints about a payment may also be taken up with the payment gateway or with your own bank.

South African law governs this agreement, and the courts of the Republic of South Africa have jurisdiction.
